online payday loans, can i got to jail for not paying?


how could i possible go to jail for not paying back a online payday loan?? there saying they are going to have me put in jail!!! but online payday loans aint like the ones right down the road it’s not like i wrote a check threw them they just got my banking info and thats it so aint this just a debt

    writing a check that you do not have the funds to cover is illegal. I doubt you would get jail time for it especially if it is your only offense.

    No they cannot put you in jail for not paying…However they will tell you anything to scare you into paying. Worst they can do is file it against your credit or put an electronic hold on your bank account so that next time you deposit any money into it…it will automatically go to them to cover the debt.

    You can go to jail if fraud was involved, like you gave any inaccurate information on your application. Did you give them a good bank account number, and accurately report your income and pay date? If so, this shouldn’t be happening in the first place, the money would have been taken out of your account the day you were paid, before you had a chance to spend any of it. If you gave the lender incorrect information, they can file a police report, and you may be subject to charges.

    We don’t have debtor’s prison in the U.S. anymore. If fraud wasn’t involved, you won’t go to jail. However, you can and will be sued in court and it will be ugly. Pay it.

    You did “write them a check” – you just did it electronically.

    There are two potential issues, civil and criminal. A post-dated check as collateral for a payday loan is not a “bad check” as defined in the laws for people who bounce checks. If the electronic check ‘bounces’, therefore, you still owe them only the original amount (plus any late fees) and not the double or triple damages that most States allow the receiver of a bad check to sue for.

    On the criminal side, yes, you can be criminally prosecuted – not for writing a bad check though, because the check was merely collateral – but for fraud. To get a conviction, the DA will need to satisfy the jury that you took out the loan with the *intention* of not paying it back, which is fraud. If you took it out meaning to pay it back, but now can’t afford to, that’s a matter only for the civil courts, not the criminal ones.
