But when I started drowning in all the fees they charge I had to close the account. So is this the same as writing a hot check even if I did not sign a paper check?
The company wants a civil suit but will I be charged for a hot check.
Should I make a arrangement to pay the company back or just go to civil court?

Sort of but all they can do is try to collect the money from you using collection agencies.
as you know by now, payday loans are a scam and i never recommend them for anyone.
i’ll put it this way though. if you close the account, it’s not like writing a hot check. it’s like you stole money from them because they gave you money you’re not paying back.
if your account was overdrafted, then THAT is like writing a hot check……… if you wrote a hot check….
here’s what can happen to you for not paying.
1. they can sue you.
2. if you put any collateral on the loan, they can reposes it.
3. if you didn’t put collateral, they can have your wages garnished
4. tons of harassing phone calls from collections departments in the meantime.
5. it knocks your credit through the floor every month you’re late on the payment.
fortunately late payments go away after a while…. garnishments and repos show for 7 to 10 years though… so… you’re screwed if that happens…
there are other things they can do too..
don’t ever do a payday loan again no matter how hurting you are for money.. it’s easier to sell some crap you dont need on ebay……. i’m sure you have lots of it… everyone does..
payday loan companies will NOT settle balances with clients….. or.. will very rarely do so. i own a settlement company, and we rarely ever get settlements from those places.
